RICS DRS adjudicator and construction law expert Andrew Wallace has recently returned from a trip to Melbourne where he presented a paper entitled “Domestic Adjudication: The Way Forward?” which discussed the advantages of having a domestic adjudication process included with Queensland’s Building and Construction Industry Payments Act (BCIPA).
Andrew looked at the success of the BCIP Act to date in comparison to other security of payment regimes around Australia.
Furthermore, he proposed several potential amendments to the BCIPA Act including discussions on domestic building contracts and resident owners, how these types of contracts could be applied to the adjudication regime, and what safeguards would be imagined. Andrew recommended that an amendment to the BCIP Act to include a scheme for domestic adjudication “is likely to result in less matters coming before the Court”.
