RICS DRS now an Authorised Nominating Authority in Tasmania

On the 30th June 2010, Kerry Crowder, Security of Payments Official, approved RICS DRS as a Nominating Authority (NA) under the Building and Construction Industry Security of Payment Act (2009). We are now available to receive adjudication applications for this jurisdiction.

RICS DRS is the world’s largest provider of alternative dispute resolution services in land, property and construction. RICS Dispute Resolution Service offers a complete range of methods for resolving disputes including: adjudication, expert determination, expert witness, mediation and arbitration.

We will soon be running an adjudication training course specifically for the Tasmanian jurisdiction. If you are interested in becoming an adjudicator, or wish to acquire the skills relevant to the operating of the Tasmanian security of payment act, or have questions regarding adjudication or our other alternative dispute services please free feel to contact us for further information our office on 1300 953 459.

DRS Open for Adjudication Business in Australian Capital Territory.

On the 1st July 2010, David Middlemiss, Constructions Occupations Registar of ACT Planning and Land Authority, approved RICS DRS as an Authorised Nominating Authority (ANA) under the Building and Construction Industry Security of Payment Act (2009). We are now available to receive adjudication applications for this jurisdiction.

Adjudication in the News: Simcorp V Titans – Round 2

Only yesterday did we write about Simcorp’s adjudication win against the Titans Rugby League club. No sooner than we had written about this on the DRS blog, another twist in the narrative occured.

Late yesterday afternoon, the Supreme Court overruled the adjudicator’s decision, ruling that the decision was to be set aside. On face value, this was due to question marks over the validity of the payment claim.

Tasmanian Security of Payment

As some of you may know, the Tasmanian government has approved security of payment legislation late last year and are currently in the process of approving authorised nominating authorities. The RICS DRS have applied to become a nominating authority in this jurisdiction. While similar in scope to the security of payment legislation in Queensland and New South Wales, the Tasmanian legislation includes some new aspects including some scope for domestic adjudication against home owners, elements which are not included within the Queensland and New South Wales implementations of Security of Payment. Subject to state approval, the RICS DRS will be conducting adjudication training for Tasmanian practitioners. Indicative pricing for these courses are as follows:

  • $2500 for the adjudicator qualification.
  • $1320 for attendees not wanting the adjudicator qualification.
  • Discounts are available for members of various industry bodies.

Simcorp pursue Titans via Security of Payment

Gold Coast builder Simcorp successfully pursued a payment claim against the Gold Coast Titans Rugby League Club by using the adjudication process encapsulated within the Queensland Building and Construction Industry Payments Act.

QBSA Licensing and BCIPA: Seminar Announcement

Considering the often confusing nature of QBSA licensing, particularly with regards to the Building and Construction Industry Payments Act, the RICS DRS have scheduled an expert discussion seminar on this issue featuring keynote presentations from the Queensland Building Services Authority and Holding Redlich lawyers. This seminar seeks to address questions over the ramifications of licensing on the adjudication process and how best to tackle any such issues.
