Security of Payment in Australia – Legislative Updates

In late 2009, all Australian states and territories have now passed Security of Payment Acts in an effort to improve cash flow throughout the entire building and construction industry.

The Australian Capital Territory’s Legislative Assembly passed their Security of Payment Act on 19 November 2009, known officially as the Building and Construction Industry (Security of Payment) Act 2009.

Jon Stanhope, MLA Chief Minister explained his reasoning behind the effecting of this legislation, stating that “The building and construction industry plays a critical role in the ACT economy. Throughout the 2007-08 financial year, there were over 15,000 people employed in the construction industry, and the value of building, construction and engineering work done in the ACT exceeded $2 billion.”

Similar to both the New South Wales and Queensland legislation, this Act is designed to facilitate recovery of payments under construction contracts in the building and construction industry. The Act will commence on the 1st July 2010. Please be aware that it will not apply to contracts entered into before commencement of the Act (1 July 2010).

In South Australia, the Building and Construction Industry Security of Payment Act 2009 received its Royal Assent on 10 December. Still no date from commencement of this act has been advised. This Act is based on the New South Wales legislation, but with some slight amendments.

And finally in Tasmania, the Building and Construction Industry Security of Payment Act 2009 enacted by His Excellency the Governor of Tasmania on 17 December and came into effect on that date. This legislation only applies to contracts entered into after that date and will pave the way for impartial payment standards for construction contracts.

Australian Capital Territory – Security of Payment Bill Update

On the 15th October 2009, Mr John Hargreaves MLA, Minister for Industrial Relations presented a bill for Security of Payment to the Legislative Assembly that will institute a statutory system is put in place to regulate the building and construction industry to quickly resolve payment disputes through an adjudication process.

The Minister commented that his reasoning behind this Bill is for “The building and construction industry plays a critical role in the ACT economy. Certification of a Subcontractor’s Charge

Recent times have seen a resurgence in the use of the “Subcontractors’ Charges Act 1974”.

Section 10 of the Act requires that a Notice of claim of charge be certified by a ‘Qualified Person’.

Please note that RICS DRS can provide the services of a ‘qualified person’ in the CBD at short notice. Please contact RICS DRS office should you require assistance.

DRS Xmas and Holiday Opening Hours

Christmas at the DRS.

The DRS would like to take this opportunity to thank your for your support throughout the year.

It has been an exciting and busy year around the office which culminated in our registration as an Authorised Nominating Authority in New South Wales during September 2009.

We hope you all have a safe and happy Christmas break.

Please read on for some important information regarding staffing and service during the upcoming festive season.

Adjudication referrals on Christmas Eve.

Please be aware that the doors to our serviced office location in Brisbane will be closed from noon on the 24th of December 2009.

However, DRS staff will still be available until 5pm AEST (Brisbane). Please feel free to contact us via telephone or email (contact details).

For documents to be physically served at our Brisbane location, directions will be posted at the entrance to our offices on how to get in contact with a DRS staff member.

Christmas Hours.

While adjudication referrals received during the period 25/12/2009 until the 03/01/2010 will not be lodged until the 04/01/2010, the first valid business day after the Christmas break in the Queensland and New South Wales.

We will still be accepting adjudication applications for the Western Australian jurisdiction during this period.

Staffing during the holiday period.

The RICS DRS will be working on a skeleton staff during the period 24th of December 2009 until the 4th of January 2010.

We will recommend “all guns blazing” on the 4th of January 2010.
