Expert witnesses play a crucial role in property and construction disputes which are often decided on expert evidence. The current economic climate is likely to bring an increase in disputes and a growing need for for experts who can deliver reports which are effective in putting a case forward.

The RICS aims to compile a panel of experts across all RICS professional & faculty groups. Attendance at this training course is an essential requirement to admission on to the panel of experts.

While this training course is primarily aimed at RICS members who with to be included on the panel, non RICS members who practice in this field are encouraged to attend.

Expert Determination Training

Expert Determination is an Alternative Dispute Resolution process which is widely used in the property and construction industry in Australia.

The RICS Dispute Resolution Service, on behalf of the RICS, is forming an Expert Determination Panel for the Oceania region to assist in the process of resolving disputes. The panel will embrace the range of RICS faculties and will be in two parts; RICS Members and Non-RICS Members. Strict eligibility criteria will apply to panel members.

This training course provides an opportunity for anyone interested in the alternative dispute resolutions processes to acquire the necessary skills to undertake expert determinations.

Who should attend?

The course is open to those wishing to be considered for the Expert Determination Panel as well as those not wanting to be considered for the panel.

Course outline

The topics covered in the training course are as follows:

  • An introduction to Expert Determination – What is Expert Determination, when should Expert Determination be used.
  • Comparison with other forms of ADR, and in particular arbitration.
  • Agreements for expert determinations – best practice and interpretation and challenges in the courts.
  • Expert Determination process – consideration of jurisdictional issues, conferences, hearings and tactics.
  • The Expert Determination decision - what to include, what to avoid, enforcing the decision, challenging the decision.
  • Liability of the “Expert”.
  • Traps and Pitfalls of Expert Determination – a practical perspective.

Panel requirements

RICS DRS required a minimum of ten years industry related experience for consideration for the panel. However, that does not preclude people from attending who are interested in receiving the benefits of this training course.
